Abuse and Takedown Policy
DRAFT – requires review by a Philippine lawyer before launch. This is a first draft. It is not legal advice and it is not final. Questions: the contact form.
Hostactor hosts websites, stores, cards and e-mail for its customers. This policy explains how to report content or activity on our services that breaks the law or our Acceptable Use Policy, and what we do about it.
A child in danger? Call the police at 911 first. To report online sexual abuse or exploitation of children, see section 6. Never download, copy or send us images of child sexual abuse: give us only the web address (URL).
1. How to report
Use the abuse report form, or write to the contact form. Please include:
- the exact web addresses (URLs), domain names or e-mail headers concerned;
- what the problem is, and when you saw it;
- evidence, such as screenshots (but never images of child sexual abuse);
- for a copyright, trademark or other rights complaint: the work or right concerned, proof that you own it or act for the owner, and where the infringing material is;
- your name and contact details, and, if you act for someone else, on whose behalf;
- a statement that the report is made in good faith and is accurate.
You will receive a reference number by e-mail. Reports with too little information may take longer, or we may not be able to act on them.
2. What happens next
- Urgent cases — phishing, malware, active attacks, content that sexually abuses or exploits children, or a threat to someone's safety: we act at once, for example by blocking the content or suspending the service, and tell our customer afterwards.
- Other cases: we review the report and, where it appears justified, tell our customer what was reported and ask them to respond or fix it, usually within 3 days.
- Depending on the result, we may remove or disable access to content, suspend or end the service, or take no action if the report is not supported. We may tell you the outcome.
- We are not a court. Where a dispute between you and our customer needs a legal decision, we may ask you to obtain one, and we follow orders of the competent courts and authorities.
3. Your privacy and our customer's privacy
- We give your name and contact details to our customer only if you agree, or where the law requires it.
- We do not give our customer's personal details to people who report them, unless there is a court order or another legal obligation to do so.
- We handle the personal data in reports as described in our Privacy Notice.
4. Copyright and other rights: takedown and response
- When we receive a complete and credible notice that content on our services infringes a copyright, trademark or other intellectual property right, we may remove or disable access to it and inform our customer.
- Our customer may respond that the content is not infringing (for example because they own it or have a licence). We may then restore it, unless you show us that you have started legal action.
- We end the services of customers who repeatedly infringe the rights of others.
- Making a false or misleading report on purpose can make you legally responsible for the harm it causes.
5. Requests from authorities
We respond to requests from courts, law enforcement and other authorities as Philippine law requires, for example a court warrant or an order to preserve or disclose data under the Cybercrime Prevention Act of 2012 (Republic Act No. 10175). We check that each request is lawful and disclose only what it requires.
6. Reporting to Philippine authorities
You can also report directly to the authorities. These channels were checked when this draft was written; contact details can change, so check the agency's official website.
